B'nai Brith target of New CHRC Hate Crimes Complaint

A new complaint has been filed against B'nai Brith. Is it specious? Vexatious? Or does it simply illustrate what a very bad law Section 13(1) really is?

This is a little confusing. Exactly how is Bnai Brith related to some website called 'Nizkor'?

What goes around comes around, BB can't use the excuse "We were quoting hateful posts" because truth is irrelevant to the CHRC.

What goes around comes around, it appears the BB will face the demon they helped create.

If they do drop a legitimate complaint because the BB were quoting "Haters" how can they justify the persecution of Mr. Lamire? Anonymous people posting before he had time to censor an opinion yet it's okay for BB to quote or espouse hate doing an end run around Section 13?

I see several scenarios intertwining:

If the CHRC asses-out as BCF calls it, then we know there was political interference from at least the upper echelon of the CHRC. We could then really suspect Fothergill’s comments of “depends upon who you are”. That would really rile a lot of people, especially the Muslim community who already had the ass-end of the stick on the MacLeans case handed to them – which we found out was also a political interference job at the upper CHRC level. I can just envisions some of the more radical elements rubbing their palms with glee.

As the basis of s13 is the likelihood of offending someone – that is a no-brainer here, especially with the Hallmarks of Hate as the new 11 Commandments. As Rose says, BB can’t claim “truth”, “intent” or “anon postings” and they will have a hard time getting around the CHRC’s stance of “no free pass for anyone”. More so since BB was there as an intervener to drive home the interpretation, methodology and support the corruption at the CHRC.

Sort of in a corner - If they say it was all a big mistake, then they need to look at Lemire, his case and his constitutional challenge. They will also have some difficulty as they promoted Richard Warman and Maximum Disruption techniques, which later were disclosed to be entrapment.

It sounds like the complainant has learned and adopted the CJC/BB and CHRC tactic.

I wonder who will be Intervenors in this one?

Will B'nai Brith have to set up a "PAYPAL" account?

Will Lucy and the Lying Jackal act as lawyers for the defense?

Damn if I can find any indication if this is actually true. Here we are believing everything we read but can anyone really verify this?

Anyone may file a complaint. Whether it is deemed to merit consideration by the CHRC is another thing entirely.

The point of this complaint is purely illustative of the many holes in 13(1).

I don't see anything odd about it at all anon. Someone has filled out a complaint form. It's a wonderful set up which rips into Section 13 (1) and exploits elements of the feeble defense mounted by the Justice Dept. and intervenors in the Lemire hearing.

In short it's a very good object lesson in the application of a very bad law.

No, doesn't jive....B'nai Brith is nothing if it ain't feisty yet not a word about this though its on the blogs. The "Canadian Jewish News" is always on top of such issues yet not a word. The last complaint filed against B'nai Brith had wide coverage in the National Post. Joseph Breen is about the most knowledgeable reporter there is on the CHRC yet he hasn't even picked this one up.

No BCF, if this were an actual complaint the coverage would be much more than here on the blog. I think its a fake and I betcha all your words come back to bite ya on the behind on this one.

Not at all, anon, B'nai Brith allowed the Manitoba complaint to drag on for years before going public in frustration.

Besides it is possible that at this point even B'nai Brith may be unaware that this complaint has been filed. The CHRC must first review it and as in Ezra's case with most recent complaint filed against him, advise the concerned parties of initial findings. That process takes time.

I have no doubt that someone filed this complaint. Will it be taken seriously by the CHRC? I doubt it.

For all that it remains a wonderfully illustartive example of all that is wrong with Section 13(1).
