Boissoin wins appeal against Insane Human Rights Commission!
Announced here.
Here's the ruling. Read page 7 to understand how Stephen Boissoin was railroaded on hearsay evidence. Do read the entire ruling, the litany of abuse committed by the AHRC throughout this travesty is simply too long to list. It is a pity that Boissoin cannot sue the AHRC for conspiracy to violate his civil rights.
Oh and Mark Steyn has the honour of being quoted in Justice E.C. Wilson's ruling;)
Boissoin Ruling
Update: Alberta judge rules anti-gay letter not hate speech, overturns ruling
Lot's of fun, Darren Lund the schmuck whines and whines and whines "In my view, the judge's ruling sets such strict standards for hate speech that this section is rendered all but unenforceable.." Suck it up Schmuck.
...
The Canadian Constitution Foundation has issued the following press release:
Partial victory for free speech in Boissoin court judgment
“In spite of today’s court ruling, Albertans need to continue to exercise extreme caution when speaking about public policy issues, lest they offend someone who then files a human rights complaint. No citizen is safe from being subjected to a taxpayer-funded prosecution for having spoken or written something that a fellow citizen finds offensive,”

I await further details but if what I can surmise from 86 on is that someone is going to pay
Rev. Boission BIG TIME and rightfully so.
6 years of torture. The HRC responsible should also pay damages for malicious prosecution but of course that is just taxpayers money.
Others that have also launched similar actions should now take a deep breath and remember Capital
One "What is in your Wallet"
Darren Lund should give his head a good long soak.
Dr. Lund...LOL
Where do they find these VOLK MM?
But Para 81 applies to so many other cases of private prosecutions...even at arms length alledgedly!
This is the best news yet. Is this the end for him, or can he now sue for damages and reimbursement?
.
.
"How sweet it is!"
Oh! "How sweet it is!"
Thank you Stephen! Thank you Ezra! Thank you Mark!
And the rest of the Freedom fighters.

Yes it is good news and he thoroughly rips into the AHRC for numerous abuses. Boissoin may be entitled to recover some costs - see the last couple of pages, but no penalty will be levied against the Christian Hater.
It's a great victory for Mr. Boissoin to whom we owe a debt for standing and fighting for our freedoms. Still, I can't but get Ezra's line out of my head: "a couple more victories like this and I'll be finished."
This is great news.
Brick by brick this odious institution that pretends it is really concerned about human rights is being dismantled before our very eyes.
Here's how Darren Lund's biography begins:
"Dr. Darren Lund is an Associate Professor in the Faculty of Education at the
University of Calgary, where his research examines social justice activism in schools and communities."
Why is it that every time I hear the phrase "social justice", I know that real justice is about to be trampled underneath?
Whenever I see the words social justice I now automatically read hatemonger.
Yup rabbit - when you hear the phrase "social justice" and add a title of Dr. or HRC commissar/apparatchik and you have a clear view of marxism at play.
But to the wonderful news - a big thanks must go out to all "free Speechniks/blog meisters" who have supported, comforted, fund raised, etc and just were there for Rev. Boissoin - "We have all come a long way Baby" but a few more steps are in the future.
Ezra must be in his glory for it is FS 2 and AHRC 0.
Very encouraging that Boissoin's odious conviction and punishment were overturned, but disappointing that Section 3 remains in force. The judge seems to have an appreciation for the fundamental issues here, but chose not to overturn Section 3 itself.
Not overturned but the phrase "...is likely to expose a person or a class of persons..." now has a clearer definition of "likely".
The whole document is well worth reading. The learned Judge was not particularly veiled in denunciating the legal incompetence of the panel.
I agree the ruling was scathing and Wilson spoke in no uncertain terms.
BCF, I have updated further to the post of mine that you referenced in your post.

As I noted, Free Speech Hero is not what Stephen had on his to do list.
I think he actually had "Become a Flat Broke Free Speech Hero punished by the process, by the end of the decade". He can put a check mark by that one now, with 4 weeks to spare.
He now even has time to get a second job to pay for being Darren Lund and Commissar Andreachuk's punching bag.
So much for the youth he was ministering to before the fit hit the shan. I guess they're just collateral damage.
The Boissoin case is just the latest example of the true punishment meted out by our agenda driven, end justifies the means, to hell with due process "social justice" set.
And in the meantime Lori Andrechuk has yet another patronage appointment, this time to the Alberta Health Services Board and Darren Lund is an associate professor in the faculty of education at the University of Calgary where he will be indoctrinating prospective teachers in the homosexual agenda.
I would rather be Stephen than either of those two delightful human (or near human) beings. AHRC's gain is Alberta Health Service's loss, and Darren Lund needs somewhere to spew his garbage, and a university is as good a place as any for him. Heck, he doesn't even have to hide.
I'm hoping that Stephen's lawyer manages to get costs from him, though it is like the joke about the 2 Irishmen walking out of a bar. It could happen.
I'm hoping that Stephen's lawyer manages to get costs from him...
They'll probably get "costs";the problem is that costs rarely cover the costs.
Yes they'd be lucky to a third
Reading the ruling, I think the judge may not be disposed to give Stephen anything from the way he ignored the presentation on costs from Chipeur's brief on Stephen's behalf.
I am still following up on this one, looking at who is saying what about the case. Here is the next instalment.
