Leftist Reaction to Ricci v. DeStefano
In a narrow, 5-4 ruling, the Supreme Court has ruled in favor of the New Haven, Conn., firefighters who sued the city for reverse discrimintion. The lead plaintiff, Frank Ricci, argued that the city's rejection of the Fire Department's promotional examination violated the Civil Rights Act of 1964 and the 14th Amendment's Equal Protection Clause. Ricci took extraordinary steps to pass the exam. He quit a second job to make time for prepartion. He also suffers from dyslexia and paid $1,000 to have his textbooks recorded to audiotape. With intense study he ended up placing 6th out of 77 people on the lieutenant's examination. Ricci's achievement is clearly a personal triumph, and a powerful example of hard work self-determination. The Court's ruling, essentially rejecting New Haven's "reverse discrimination" policies, would appear to be a no-brainer. But no blacks or Hispanics performed well enough on the exam to be offered promotion, the city claimed potential liability from "disparate impact" lawsuits and threw out the results.
Much is being written, of course. My interest here is to record a few example of reaction on the far left of the spectrum. Clearly, leftist victimology, and continued claims of "accumulated disadvantages" of racism and "institutional discrimination" are driving the discussion on the left. We've never, in the history of human communication, made an idea unpopular by making it illegal. Weimar Germany had some of the most aggressive anti-hate-speech legislation the West has ever seen. If censorship worked as a tool to prevent hate, we would never have witnessed the horrors of the Holocaust.
Censorship, in fact, makes hate worse. It draws attention to the toxic views of those who belong on the fringe. It creates sympathy for them, allowing them to claim martyrdom at the hands of a government gone mad with political correctness.
Most frightening to me, censorship fuels the agenda of scarier, non-fringe enemies of equality. I think especially of Ezra Levant, who has found a new career as a human rights "victim." He's using his newfound platform to unfairly attack, ridicule and distort the work of human rights commissions. He won't stop until there's nothing left of the system that is so vital in the protection against discrimination.

Lynch is really at her evasive, dissembling best, which makes for yet another nail in the coffin of our Little Stalins. The Dean Steacey "Freedom of Speech is an American concept" stuff is hilarious, you can almost hear Roy biting his tongue at the end.
At the 34:51 minute mark Ms. Lynch says the CHRC would not condone signing up on "Hate Sites" and posting racist comments in order to entrap miscreants, I quote" We would not post hate, we have not done it and we would not condone it".
Except that the CHRC has condoned it Jenny. This is a sorta kinda recent decision sorta... made like maybe a year ago, yea that's the ticket...according to Jenny. Recent? Like when the public got wind of it Jenny? Your the Commissioner Jenny how come you wouldn't know the exact date when it was decided that maybe the ramifications of this Stalinist practice were a little more serious than merely bad PR? What incident(s) precipitated this change of heart? Are you simply being disingenuous or does it speak to your incompetence, is that it?
The take away from this interview is that Kommissar Lynch hasn't a clue about the history of hate messages and entrapment efforts central to Section 13 (1) prosecutions, it's doubtful she's even vaguely aware of the other abuses her own staff have in fact readily condoned. Or it may be that she simply won't fall on her sword and publicly acknowledge that the CHRC has been run in a corrupt manner under her watch - (But Jenny, while you likely had no intention of doing so, in this interview you have acknowledged the rot, just not in so many words, nudge, nudge, wink, wink;). Any way you slice it way that's incompetence or she really is a liar.
Or maybe it's a combination of the two, Jennifer Lynch may simply be an Incompetent Liar.

Two successful books have been penned calling for an end to the rule of the HRC's soft-fascists. Commenter's from across the nation have echoed the same cry in newspapers and blog posts, and contrary to Ms. Lynch's sneering, smear tactic assertions support for the repeal of these censorship laws is bi-partisan.
Civil rights icons such as Alan Borovoy have come out against the odious Section 13(1). Senator Jerry Grafstein again an early proponent of the HRC concept is on record as stating that these public institutions have been hijacked by extremists.
The CHRC's own hand picked man, Richard Moon has told Jennifer Lynch to get out of the censorship business. Yet Queen Jennifer dismisses her critics with a wave of her Imperial Hand.
How can this woman still not get the message? The speech she gave to her CASHRA sycophants was a dishonest smear that has illustrated the need to have Ms. Lynch and her fellow travellers shut down.

We already have a formal way of dealing with people who wilfully promote hatred. It's called the Criminal Code. A courtroom is the proper place to adjudicate such cases -- not a Star Chamber of Thought Police.

Now as for the alleged threat, if true then that should be dealt with by the proper authorities - but shame on you Jennifer Lynch for implying a blogger or journalist made such a threat. Cheezus Jenny your staff at the CHRC as well as the CHRT have substituted evidence, tolerated misleading testimony under oath and abused due process, and even your agencies own procedures - repeatedly - in short your staff have no credibility or reputations worth upholding. You and your agency lack accountabilty and have rightfully earned the publics scorn.

Since passage of the human rights act in 1977, 72 complaints have been filed and accepted under Section 13, of which six are still pending.
Forty-nine were resolved without a hearing, and 17 went to the tribunal. Of those, the tribunal has upheld 16, most of which were filed by Ottawa lawyer and anti-hate activist Richard Warman.
Moon picked up on those facts in response to Lynch’s argument that prosecutions would dry up if Internet hatred was left to the police.
The human rights tribunal hears very few Section 13 cases either, Moon pointed out. “In the absence of Richard Warman, there really is very little happening under Section 13. You take him away, you’ve got nothing.”

Rights commission rejects calls to stop investigating online hate
Canada's Human Rights Commission has rejected suggestions that it stop investigating hate messages on the Internet, saying the issue shouldn't be left solely to the Criminal Code.

This is more than an insult to Canadians, it is an assault on the values of free expression and democratic liberty. The CHRC is a corrupt, power mad bureacracy staffed by radical leftist zealots who have abused their power repeatedly and with impunity. This travesty cannot be allowed to continue.
The alleged Canadian Human Rights Commission and the Canadian Human Rights Tribunal have demonstrated their corruption time and again. These illegitimate bodies have tolerated the abuse of due process, misleading testimony under oath, evidence substitution and have in the words of Senator Jerry Grafstein been hijacked by extremists. The CHRC cannot be trusted to reform itself, they are a rogue organization that must be cleansed completely.
Are these words on the Conservative Party web site - Stand Up for Canada - the empty rhetoric of a "Brokerage Party?
Write the PM, write your member of parliament , write the members of the Justice Committee - Stop the CHRC. Let the members of the CPC know - no more donations, nothing - until Section 13 (1) is removed from the Canadian Human Rights Act and a full judicial inquiry is launched into the corruption at the CHRC.

The Facts ( as the CHRC see's em)
Confidentiality is an important issue with the Commission. When a complaint is filed with the Commission, it and all matters pertaining to the complaint are treated as confidential. Confidentiality is needed to protect the integrity of the process and ensure that parties remain focused and not influenced by comments or interpretations made outside the Commission.
Now the Reality:
Rizk wasn't just Warman's colleague, trainee and then successor. She became his girl on the inside of the commission. He would call her regularly and they would chat about the complaint (page 4464) but Lemire, the respondent, had to wait up to a full year before Rizk would send him documents as required (page 4462).
Warman didn't just chat with Rizk. He gave her instructions. In one stunning call, Warman told Rizk that he had filed a complaint against Lemire with the police, and that he wanted Rizk to slow down her work to let the police pursue possible criminal charges. He told Rizk not to disclose this information to Lemire. Rizk confessed under oath that she followed Warman's instructions, though she now realizes that was improper conduct on her part (pages 4466-4467, 4469, 4478).
Warman had other people call up Rizk, too. He had a policeman call her up to ask for her file on Lemire. To her credit, Rizk declined -- but not for Warman's lack of trying (page 4472).

In honour of the 65th anniversary of D-Day here's a blast from the past:
Ron Jenkins father was a pioneer in the grocery business in Calgary and Ron was involved in the family business both before and following his wartime service as a bomber pilot. Canadian built Lancaster KB-895 become his personal aircraft with code "WL-O." The crew decided that "their" bomber needed a name and nose art painting. At first they named her "Wee Lady Orchid" for each of the code letters. Later they dropped the "Wee" and she became "Lady Orchid." The painting of the Lady Godiva pin-up riding a bomb included two western style six shooters to reflect Jenkins' Calgary connection. F/O Jenkins flew a total of fifteen operations, five in Lady Orchid. Under his pilot's position he painted fifteen white bombs and one red bomb for an aborted operation.
