Trapped behind a human barricade, the abortion rights people began to push and hit. It was an ugly, scary scene. The police arrived and started carting people away. And from my spot to the side, I saw police pick up a priest I liked and haul him to their van. A priest. Suddenly, I wiggled through the crowd and sat right down in his place. A police officer stared down at me.
“Are you gonna walk or are we gonna have to carry you?” he sighed.

New concerns over the abuse of Section 13(1)
CNS News:Islamic Nations Seek Legally Binding Way to Counter Religious ‘Defamation’
"As support wanes for its campaign to secure controversial but non-binding “defamation of religion” resolutions at the United Nations, the Islamic bloc is pushing ahead with an alternative route – one that would carry the weight of international law.
The OIC is now attempting to have a key U.N. panel amend an existing international treaty to encompass supposedly religiously defamatory speech.
Unlike the resolutions, changing the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) to cover religion would be legally enforceable..."

Canada is a signatory to the ICERD. The Canadian Human Rights Commission cites observance of ICERD as a Canadian legal obligation in it's defense of our Thought Crime law, 13 (1).
Beyond the CHRC itself the limited support for Section 13 (1) stems from the opposing sides in the ongoing Arab Israeli conflict. Advocacy groups such as the Canadian Jewish Congress and the Canadian Islamic Congress each hope to use Section 13 (1) to limit, if not in fact outlaw political speech they disagree with.
The effort to incorporate the Islamist inspired "Defamation of Religion" in ICERD is simply the latest salvo in the Mid-East proxy war being fought by aggrieved minority groups at the expense of all Canadian citizens charter right to free speech. Worrying steps are also being taken by some members of Canada's Jewish community which are perceived by many on the left as an outright attempt to criminalize criticism of Israel.
The proxy war being fought over free speech is perhaps the single strongest reason why Section 13 (1) must be deleted.

Re:Writer disagrees with the use of a Christian symbol at the boardwalk.
Eric Sampson believes Pembroke is behind the times and believes that the cross wags an impudent finger at multiculturalism. This is typical relativistic tripe, the same mentality which insists "Merry Christmas" be replaced with "Season's Greetings" to avoid offending anyone's religious feelings.
This is part of the same battle being fought against the Canadian Human Rights Commission's Section 13, which squashes and eliminates the very symbols of the founding morals of our society and calls it a preservation of free speech.
This is not about one ideology getting preferential treatment over another, or about neglecting others. This is about recognizing the existing cultural inheritance of the founding members of the Ottawa Valley. The method in which Mr. Sampson whines about the cross is endemic of the Human Rights Commission supporters and their culture of entitlement.
Nobody cares if Mr. Sampson is offended at the "inconsiderate" display of a religious symbol, nobody except for those who believe the citizens of Canada have a right not to be offended.
And if the latter truly comes into law, we'll lose our freedom, which in Canada came from attitudes cultured by people who grew up under the shadow of that very symbol, and for which many have died for and are remembered every November 11.
Will Mr. Sampson also take offence to the overt display of religion during the laying of wreaths and the prayer during Remembrance Day ceremonies?

The battle to control Section 13 (1) is just one more front in this same proxy war. Both sides in the Middle East conflict as represented by the Canadian Islamic Congress on the one hand and B'nai Brith and the Canadian Jewish Congress on the other hope to manipulate our thought crime law to further their respective political agendas. These warring factions represent virtually the entirety of support for Section 13 (1) with each side in the middle east proxy war endeavoring to use the Canadian Human Rights Commission as a political weapon to the detriment of us all.
I understand the misguided belief, held by a segment of the Jewish community, that it needs to fight on this front, however it must be pointed out in no uncertain terms that a successful effort to preserve Section 13 (1) will prove a Pyrrhic Victory.

Debunking the CJC's Legal Champion Alexander "Specious" Tsesis
The Canadian Jewish Congress has just published a disingenous justification for Section 13 (1), I wrote about that here yesterday. Of particular note is their continued reliance on the flawed work of an obscure lawyer, Alexander Tsesis to justify 13 (1). Tsesis' unsound reasoning thankfully contributed to the failed Justice Department effort to derail the Section 13 (1) Constitutional Challenge. In response to the CJC's continued effort to misinform the public I am republishing in part a post I wrote in May of 2008 in which Professor Anuj Desai debunks the work of the CJC's erstwhile legal champion "Specious Tsesis".

Professor Desai authored Attacking Brandenburg with History:Does the Long-Term Harm of Biased Speech Justify a Criminal Statute Suppressing It?
It is a criticism of the theory presented by Alexander Tsesis in his book: How Hate Speech Paves the Way for Harmful Social Movements. Tsesis work has been cited as a justification for Section 13 (1) in the legal brief prepared by the Department of Justice that attempts to dismiss the pending Section 13 (1) court challenge.
Abstract:
Racist speech has long been the subject of significant controversy in First Amendment jurisprudence and scholarly commentary. In a recent book, Alexander Tsesis argues that, when systematically developed over long periods of time, "hate speech" lays the foundation for harmful social movements that ultimately result in the oppression and persecution of "outgroups." From this premise, Tsesis argues that the United States Supreme Court should overrule Brandenburg v. Ohio, the case in which the Court held that advocacy or incitement must be likely to result in imminent harm before it can be constitutionally proscribed. Tsesis's book then proposes a model statute to criminalize "hate speech" based on the long-term harm such speech can cause.
In this Essay, I question the book's premise and its conclusion. My principal argument is that Tsesis misunderstands one of the underlying bases of the "imminent harm" requirement in Brandenburg. Rather than being premised on a view that speech cannot cause long-term harm, Brandenburg's "imminent harm" requirement is designed primarily as a prophylactic rule to prevent government from using a long-term harm rationale to suppress speech based on the government's view of truth. To support a law criminalizing speech, therefore, it is not enough to rely on the long-term harm that the speech can cause.

I'm not aware of anyone else who has directly addressed Tsesis, in part because, as you imply, he is not particularly well-known here in the U.S. There was another review of his book in the Michigan Law Review by W. Bradley Wendel, who is now at Cornell Law School, although Professor Wendel doesn't address Tsesis as directly as I do: The Banality of Evil and the First Amendment, 102 Michigan Law Review 1404 (2004) (reviewing Alexander Tsesis, Destructive Messages: How Hate Speech Paves the Way for Harmful Social Movements).
However, here are a few suggestions of reading on the general topic that might be of help. A comprehensive book that addresses the broader issue is James Weinstein, Hate Speech, Pornography and the Radical Attack on Free Speech Doctrine (Westview Press, 1999).
Despite its title, it is not polemical at all and very carefully goes through and responds to many arguments in favor of hate speech prohibitions.
There is also a collection of essays entitled Speaking of Race, Speaking of Sex (NYU Press, 1994). It includes a fabulous piece by Henry Louis Gates, Jr. entitled "War of Words: Critical Race Theory and the First Amendment." Gates is the director of the W.E.B. Du Bois Institute at Harvard and probably the most prominent professor of African American Studies in the U.S. The piece was originally in The New Republic (Sept. 20 and Sept. 27, 1993) and its original title was "Let Them Talk."
There is also another excellent article in that book by Robert Post entitled "Racist Speech, Democracy, and the First Amendment". It was originally in the William & Mary Law Review- 32 WM. & MARY L. REV. 267 (1991).] Post is a law professor, then at Berkeley and now at Yale, and is universally viewed as among a handful of the finest constitutional law scholars in the United States. I can say unequivocally that all three of these scholars are far more prominent and respected than Tsesis, although again, I should emphasize that they don't directly address Tsesis's book (indeed, the pieces I'm mentioning are all written before Tsesis's book).
