Free speech victory in Whatcott v. Saskatchewan Human Rights Tribunal
CALGARY: The Canadian Constitution Foundation (CCF) today responded to the Saskatchewan Court of Appeal decision in Whatcott v. Saskatchewan Human Rights Tribunal, a case in which the CCF had intervened in support of free expression.
In a decision released February 25, the 3-member court ruled that William Whatcott did not violate section 14(1)(b) of the Saskatchewan Human Rights Code by distributing flyers to oppose the teaching of homosexuality in Saskatoon’s public schools.
The flyers distributed by Mr. Whatcott in Saskatoon and Regina in 2001 and 2002 were polemical and inflammatory, and the court noted in its decision that many people would find his words “crude, offensive, and pejorative.” The contents of the flyers are re-printed in the court’s decision, posted HERE.
The CCF intervened in support of free expression. Its factum is posted HERE . You will note that many of the CCF’s arguments were adopted by the Saskatchewan Court of Appeal, sometimes with an express reference to the CCF (see paragraph 130 of the court’s decision) and sometimes without an express reference.
The Court set aside a Human Rights Tribunal Order that Mr. Whatcott pay $17,500 to four gay complainants who were offended by his flyers. The Saskatchewan Human Rights Code prohibits the publication of any statement which “exposes or tends to expose to hatred, ridicules, belittles or otherwise affronts the dignity of any person or class of persons” on the basis of age, race, religion, sexual orientation, and other grounds.
“This court decision is good news for free speech,” stated lawyer John Carpay, Executive Director of the CCF, which intervened in support of the right of citizens to express their religious and political opinions on matters of public policy.
“Unfortunately, the court did not strike down the restrictions on free speech. But nothing prevents our federal and provincial politicians from repealing these laws,” continued Carpay

The Canadian Jewish Congress is an organization run by religiously liberal Canadians who happened to have been born Jewish.
In addition to its claim of being the “official voice” of Canadian Jewry (though unelected by a majority of Canadian Jews), the mandate of the OJs (official Jews-thanks, Ezra) is ostensibly to protect Jewish interests in Canada –politically, spiritually and physically.
Unfortunately, in recent years, it has degenerated into an organization whose “social justice” agenda is barely distinguishable from a myriad of other left-leaning organizations in Canada. From issues of Aboriginal poverty, homelessness, the relentless pursuit of marker-wielding “neo-Nazis”, its de facto pro-censorship stand, and its absurd and antithetically un-Jewish obsession with “hate speech”, the CJC’s political activism has mirrored the general, world-wide trends of Jewish assimilation into more socially palatable left-wing and universal causes. My people-they just never learn…
Despite its relentless pursuit of inter-faith dialogue, and the 100% non-reciprocal financial, religious and political support of communities such as the Somali Muslim community in Canada (how many UJA donors like their money going to Somali students instead of the Board of Jewish Education-has a poll been commissioned), there are Jewish communities worldwide that are perhaps more deserving of a CJC focus.
Take for example, how the CJC in its all its liberal, multicultural glory, sponsored a “Shabbat for Darfur”. Earlier in the year, it Celebrated Diversity Through Twinning! Remarkably, the fact that Haroon Sadidqui cheers it on causes the OJ not a whit of discomfort! But while the enlightened Jews show the Muslims how to dance the hora, and the Muslims invite CJC executives to break the Eid fast – Malmo burns.
It is therefore in the spirit of true Jewish activism, the spirit of “Kol Yisrael Arevim Ze L’Zeh” (all Jews-all of the people of Israel - are the guardians of one another) that I extend the “Shabbat With Malmo” challenge to the Canadian Jewish Congress.
Did anyone at the CJC read about what’s happening to the Jews of Malmo? Even the goyim have noticed! A shanda!
(Note: It was difficult to choose between the Shabbat for Malmo and a “Shabbat for Paris”. Has anyone at Congress been keeping up with how the quaint “youths” of Paris relate to their Abrahamic cousins in the banllieus of gay Paris? Let’s assume they have not been keeping up to date about Eurabian Jewry. A review is in order. Let’s go back to the article on Malmo:

Regarding your phone call to me tuesday evening, I would like to make it clear why we have chosen to protest the offices of Palestine House in Mississauga.
On Saturday, ِApril 3rd, Palestine House will commemorate the 34th anniversary of Land Day, with Mr. Abdul Bari Atwan. Talking about Iran's nuclear capability on ANB Lebanese television on June 27, Abd Al-Bari Atwan, editor-in-chief of Al-Quds Al-Arabi newspaper, said, 'If the Iranian missiles strike Israel, by Allah, I will go to Trafalgar Square and dance with delight.'
As a Jew and a Canadian, I find this genocidal rhetoric offensive and dangerous. You referred to it as 'foolish' and to just be ignored. I will never ignore those that preach genocide. A public figure with your stature and experience should know that this type of language incites hate and violence – and in today’s climate, should not be tolerated in any community. I must say, quite frankly, that I find your request for me to cancel the demonstration to be highly inappropriate.
Further, you told me that you are 'intimately involved' with Palestine House – I’m not certain what 'intimate involvement' means but I would suggest that you should use your influence to have this organization cancel their speaker and render a public apology.

I received my CHRC access to information request results today, as you can see it's comprised of 8 pages of "information" 5 of which are almost completely blanked out.
The first 2 pages are CHRC e-mails which contain the "Protected Solicitor Client Privilege" cautionary. Both e-mails have as the subject "Stand alone computer & access to web sites".
Now I'll give Jennifer and her Flying Monkeys the benefit of the doubt and assume she isn't contemplating restricting MY access to "stand alone computers and web sites", for now;)
Based on the subject lines alone, but also on the inclusion of an unredacted copy of one of my statcounter reports detailing multiple visits by the CHRC, I have to assume that Kommissar Jenny is deathly afraid of her staff reading my blog. Pathetic Petty Totalitarianism thy name is Jennifer Lynch.
My layman's understanding of solicitor client privilege suggests its use may in fact be correctly applied in this instance. This assumes my inference of Jennifer's effort to keep her staff from seeking The Truth The Light and The Way of Catfur is correct.
If for instance counsel for the CHRC were contemplating disciplinary action against staff for having visited or the formulation of a conduct directive forbidding employees to read my blog that might get them off the hook.
But I don't roll over that easy and if there's one thing we've learned; never trust Jennifer Lynch and the CHRC. So yes the invocation of solicitor client privilege may well be a cover-up.
We shall see what my appeal brings to light.
That said, I've always suspected I had a fan or two at the CHRC, what else could explain their devoted readership. I suppose I was wrong about some of them at least, and now ask their forgiveness for having viciously mocked their Christmas Day Visit, perhaps I was the only joy they knew that blessed day. Such are the burdens of Freedom Fighting.
Still it's inspiring to think I may have caused a rebellion at the CHRC against Kommissar Jenny's rule.
As a Freedom Loving Cat I must pursue this for the sake of truth and the oppressed CHRC staffers - YEARNING TO BE FREE!

Much to my disappointment I was denied access to tonight's IslamoPalooza ThugFest - see the flyer below, I was declared "media non-grata" (note to self - next time hide camcorder). Islamists have no sense of irony, the conference topic was "The Media War On Islamists" and there I was happy to give them all the coverage they craved. Cripes who pissed on their Wudu Washer? Oh yea, I did.
It may be that Khomeinist Apologist Zafar Bangash and his punks were spooked by the protest organized by Iranians denouncing the presence of Hamid Mohammadi Dammadi Doo the Iranian Cultural Attache to Canada. Maybe that was it, but most likely they feared exposure by their great nemesis Undercover Kuffar, yea that's it.
Also scheduled to speak at tonight's bilefest were Khaled Mouammar, Ali Mallah, Ed Corrigan, Michael Keefer, James Clark and the Loneliest Sockpuppet - Khurrum Awan.
At any rate I did get a statement from one of the Iranian protestors.
